STERN V. MARSHALL AFTERSHOCK:
SEISMIC SHIFT, MINOR TREMOR, OR JUST A LOT OF THUNDER?

WHO SHOULD ATTEND: All lawyers who practice in bankruptcy court, including consumer bankruptcy practitioners (debtors and creditor), trustees, business bankruptcy practitioners (debtor and creditor), and bankruptcy and other federal court litigators, at all experience levels.

OVERVIEW:    A commentator recently remarked that “if 10 years ago a poll had been taken of lawyers asking them to predict the individuals who would have the most significant impact on federal jurisdiction in the first decade of the 21st century, it’s a safe bet that Anna Nicole Smith’s name would not have shown up on many ballots”.  And, yet, the battle over her late husband’s probate estate resulted in a decision that some have called a constitutional bombshellthat will forever change the landscape of federal jurisdiction. 

Since the summer of 2011, more than 700 written decisions have cited Stern v. Marshall with results as varied as the cases.  In a point/counterpoint dialogue, the panelists will discuss whether the Supreme Court appropriately limited the authority of bankruptcy courts to enter final judgments in certain cases and other issues implicated by the Stern v. Marshall decision.

  2.          2. Whether Stern v. Marshall opened a jurisdictional dispute floodgate.
