FILING YOUR MEDICAL MALPRACTICE CASE: IT'S NOT AS EASY AS IT USED TO BE!

AUGUST 18, 2010

OVERVIEW: Significant new requirements that precede and accompany the filing of a medical malpractice lawsuit were added by the Tennessee legislature in 2008 and 2009.

The new requirements include written notice to providers of potential claims, HIPAAcompliant medical authorizations, and certificates of good faith. Failure to comply with any of these requirements could result in the dismissal of your lawsuit.

The program presenters handle medical malpractice lawsuits regularly and will help you avoid practice pitfalls.

YOU WILL BENEFIT KNOWING ABOUT:

  • The required content of the notice which must be sent to potentially liable providers
  • The requirement to provide medical records
  • The certificate of good faith concerning consultation with an expert witness before
    filing suit
  • The time frame for compliance with the new requirements
  • How the courts are enforcing the new requirements
