Summary
The 2018 Farm Bill removed hemp (Cannabis sativa containing less than 0.3% delta-9-THC) from the definition of “marihuana” under the Controlled Substances Act. Consequently, applications to grow hemp in Tennessee jumped from 226 in 2018 to over 2900 in 2019. However, supply appears to have outgrown processing capacity. Seth Ogden of Patterson Intellectual Property Law will discuss various patent and trademark protections for cannabis businesses. He will explore various protections for cultivars, including utility patents, plant patents, and plant variety protection act certificates, as well as the differences in availability of intellectual property protections for hemp versus marijuana. Robert Mikos will discuss proposed changes to federal cannabis law that go beyond the 2018 Farm Bill, including new congressional legislation and proposals to legalize cannabis via Executive Action. Philip Clark will focus on the viability of the plain smell test for probable cause searches and the use of K-9 searches in view of hemp legalization.
