Summary
When someone is sentenced for a crime, they rarely serve the full sentence. But how long will they actually spend in jail, and how is that time calculated? Often the answers to those questions require more than plugging the sentence into an equation or consulting a table of numbers. Criminal history, multiple sentences, prior jail credit, and behavior while incarcerated can all impact the length of time a person actually serves on a sentence. This can make it increasingly difficult for attorney’s to accurately advise clients, for prosecutors to meaningfully inform victims about cases, and for judges to ensure litigants understand the proceedings.
This program will provide an overview and a detailed look at the mechanics of time computation for sentences in State Court. Presenters will include a representative of the Sentence Management Services (SMS) group at the Tennessee Department of Correction, as well as a representative from the Time Computation department in the Davidson County Sheriff’s Office. Between these two organizations attendees will hear how both felony and misdemeanor sentences are handled at the state and local level.
