Summary
Whether viewed as “planning for divorce” or “planning for marriage,” with the increased number of blended families (roughly half of all families are “blended”), prenuptial and postnuptial agreements are a necessary (and needed) part of “planning.”
This session will discuss:
• the statutory foundation for prenuptial and postnuptial agreements,
• the necessary components of such agreements,
• the case law that defines the line between a valid prenuptial and a prenuptial open to challenge, and
• how best to address these issues with your clients and those they intend to marry (or to whom they are already married).
Additionally, this program will review::
• common marital agreement provisions (prenuptial and postnuptial agreements),:
• how trusts can be used in this context, and:
• practical planning in light of modern trust drafting techniques, including sample clauses.
The program is intended to be suitable for both estate planners, matrimonial attorneys, financial advisers, and allied professionals. You will learn that those agreements are like a box of chocolates—you never quite know what you are going to get!
