Summary

The use of mandated arbitration in employment disputes has been on the rise for several years, and it does not appear to be letting up. However, there is still much uncertainty of the nuances which set arbitration apart from litigation. This seminar provides practical guidance on how to handle a case when faced with the reality of arbitration - from drafting the demand, arbitrator selection, the case management conference - through discovery, hearing and award. Particular emphasis will be placed on the Employment Rules of the American Arbitration Association.
