FCA Enforcement Priorities under the New Administration

This presentation will offer attendees a comprehensive overview of the new administration’s enhanced enforcement priorities under the False Claims Act (FCA), with a special emphasis on the healthcare and life sciences sectors. We will examine the role of the newly established DOJ-HHS FCA Working Group—which brings together leadership from HHS’s Office of General Counsel, CMS’s Center for Program Integrity, HHS-OIG, and DOJ’s Civil Division—in coordinating cross-agency efforts to strengthen enforcement in key areas, including Medicare Advantage, drug and device pricing, Anti-Kickback Statute (AKS) violations, and Electronic Health Record manipulation.

The session will also cover the DOJ’s three-year Whistleblower Pilot Program, launched in August 2024, and discuss its implications for healthcare qui tam enforcement. To illustrate these priorities in practice, we will review recent case examples and enforcement actions, highlighting how these initiatives are shaping FCA enforcement in the healthcare and life sciences space.
