2021 YLD OFFICERS ANNOUNCED
The YLD held their Annual Meeting last Wednesday at Meet + Greet Nashville to elect their 2021 Officers. After obtaining the appropriate permit from Metro Health, there was about 20 people in person and 25 Zoomers in attendance. It was the first time the YLD had an in-person gathering since March, and everyone very much enjoyed visiting with each other. Congratulations to everyone who was elected to the 2021 YLD Executive Committee!

2020 HIGH SCHOOL INTERN PROGRAM
This summer, the NBA Diversity Committee’s High School Intern Program hosted six high school students who participated in seven-week internships (mostly virtual) with Baker Donelson, Cornelius & Collins, Frost Brown Todd, Juvenile Court, Sherrard Roe Voigt & Harbison, and the TN Attorney General’s Office.
A special thank you to these offices for participating in this important program during the current pandemic. We missed being able to meet together in person, however, we had virtual Lunch-and-Learn programs every Friday. The students met with Stephanie Toussaint, Paz Haynes, Amy Bryant, Cornell Kennedy, Deputy Mayor Brenda Haywood, Judge Melissa Blackburn, Chief Judge Waverly Crenshaw, Judge Angie Dalton, Judge Richard Dinkins, Tricia Herzfeld, Senator Jeff Yarbro, attorneys at the TBI, and recruiters at Belmont and Vanderbilt Law Schools.
Thank you to Srihita Adabala (Ravenwood), Rebecca Bays (Mt. NBA SEEKING APPLICATIONS FOR DIVERSITY RECOGNITION AWARDS
Each year at our Law Day Lunch, we recognize law firms, corporations, and agencies who have participated in these Diversity efforts. On August 13, in collaboration with the Lawyers Association for Women, we are holding a very special event celebrating the 100th anniversary of the 19th Amendment. This event will encompass CLE credit, and aspects of our annual Law Day Lunch, including the announcement of the NBA Diversity Recognition Awards.
This year, the NBA Diversity Committee has enhanced the criteria for the Diversity Recognition Awards. These awards are aimed at legal related departments, firms, and businesses who have demonstrated outstanding leadership to promote diversity and inclusion through education, innovation, collaboration, development, and mentorship programs within their organizations. There are three recognition levels: Leadership, Sponsorship, and Participant.
The Diversity Committee is responsible for determining IF an organization is eligible for an award and at what level. Please provide thorough details for each of the elements that are marked affirmatively. This submission is for diversity efforts during 2019. If you have additional information or documentation you would like to be considered with your application, please email Traci.

LETTER FROM THE PRESIDENT: HISTORIC COURTHOUSE | BREAKING COURTHOUSE NEWS
Last night, we watched as the Historic Courthouse became the backdrop of the recent protests in response to the death of George Floyd. I am writing to provide you with information about the damage suffered. Undoubtedly, the greatest suffering is in mourning the senseless death of George Floyd. In the last several weeks, we have seen the deep-seated issues of racial injustice in our country once again take center stage, and we are reminded of the words of Dr. Martin Luther King, Jr. who said: “Injustice anywhere is a threat to justice everywhere.” As lawyers, we know the importance of the rule of law in our justice system and we know that the rule of law is threatened when laws are not fairly applied or fairly enforced.
We have been advised that the Historic Courthouse suffered significant internal and external damage, including at least three fire points on the West side of the building and at least one fire point on the East side of the building. Three people were able to enter the building, and video shows they fled after the building’s fire suppression system engaged and was activated on the first floor, ground floor, and basement.
A private repair contractor, with the assistance of the Nashville Fire Department, was able to push all the standing water outside, and the private repair contractor then began vacuuming the floors in the water-affected areas.
The power is out in the Jury Assembly Room and parts of the ground floor. The ceilings in the Jury Assembly room, Finance offices, and the Mayor’s office are either waterlogged or bowing. Water in the basement area has been pushed into the tunnel to drain. The Security Office suffered significant water damage.
The Plaza side of the exterior of the building suffered extensive graffiti and glass breakage. All first floor windows on both sides of the brass doors are shattered. There are multiple broken windows on the second, third, and fourth floors on the Plaza side across the front of the building. Some are courtrooms and judges’ chambers. The repair contractor will be boarding up the windows.
All globes in the exterior decorative lights on the Plaza side are broken and the poles are damaged.
The Civil Rights artwork on the West side of the Plaza was also vandalized.
The Tennessee Supreme Court building also sustained graffiti damage and broken glass on one of the doors.
As the Nashville community comes together to repair the physical damage to the Historic Courthouse and other property, we must also come together to rebuild public trust and repair injustices in our society that inflict trauma, pain, and fear upon our colleagues, friends, and neighbors. We are upset and saddened over the destruction to the Courthouse, but we must not let these emotions hold us back from the hard work we have ahead of us in the coming days, weeks, and months. We must continue to have difficult but important conversations about explicit and implicit biases in the legal profession and beyond, and work together as a community to root out racism, prejudice, and discrimination.

Before providing an additional courthouse update below, I first want to advise that in light of the current issues with COVID-19, the NBA team will be working remotely Wednesday, March 18 through Tuesday, March 31. The NBA is open for business and online during normal working hours; however, responses may be slightly delayed. Thank you for your understanding.
Turning to important updates regarding courtroom procedures in light of the Supreme Court order on Friday, we have received additional information about Davidson County Criminal trial courts and additional orders from judges of the Davidson County Circuit Court, including Judge Binkley and Judge Jones.
Davidson County Criminal Court
We have received notification from the Criminal Court Clerk of the following changes to the dockets for all Davidson County criminal trial courts:
⦁ In any case where the defendant is not currently in custody those matters will be continued to a later date. These individuals should check with their attorneys, bonding companies, and the criminal court clerk’s website for their new court dates.
⦁ Arraignments for defendants who are in custody will be held via video conference with the court. The times for these arraignments will be staggered by division as follows:
- Division VI – 8:30am
- Division I – 8:45am
- Division II – 9:00am
- Division III – 9:15am
- Division IV – 9:30am
- Division V – 9:45am
⦁ Any attorney seeking appointment on an arraignment must be in the courtroom on time to ensure the court’s schedule is not interrupted.
⦁ Probation violations for defendants who are in custody will be scheduled and heard as usual.
⦁ Discussion cases for defendants who are in custody will be heard only if the case is ready to plea.
⦁ Bond motions for defendants who are in custody will be heard if the parties are prepared to have the hearing.
⦁ Attorneys should notify the court and court clerk if they have an individual who meets one of the above conditions to be transported. Only individuals who are absolutely necessary for the day’s proceedings will be transported.
⦁ Any special or urgent situations not addressed by the schedule above must be discussed between the parties and the court to determine if an exception to this schedule is required.
These scheduling modifications will remain in effect through March 31, 2020.
Davidson County Circuit Court
Fifth Circuit Court | Judge Joe Binkley
Judge Binkley has set out the procedure for Fifth Circuit Court in a detailed notice. Lawyers are encouraged to read the notice in full for important procedural details. The highlights include:
• The Fifth Circuit Court will conduct all regular Friday motion day hearings as well as other Court determined emergency and non-emergency proceedings by telephone until further notice.
• The Fifth Circuit Court is willing to conduct telephone proceedings along with the receipt of limited testimony, where testimony is necessary.
• For motions and petitions that parties expect to be heard on a day other than the regular Friday motion docket, the parties shall email courtesy copies to chambers and direct them to Trace Bandel and/or Marla Guinn.
• Proposed orders for the April 6 settlement approval hearings, the petition(s), exhibit(s), affidavit(s) and proposed Orders must be emailed to Trace Bandel and Marla Guinn no later than 3:30pm the business day preceding the settlement date. Include your contact number so the Court may call you on the date chosen to conduct the settlement approval hearing.
Eighth Circuit Court | Judge Kelvin Jones
Judge Jones has set out the procedure for Eighth Circuit Court in a detailed notice. Lawyers are encouraged to read the notice in full for important procedural details. The highlights include:

We continue to work to provide you with updates on the procedures of our courts following the Tennessee Supreme Court’s order suspending most in-person courtroom hearings in light of the COVID-19 pandemic. Below is the latest from the following: Davidson County Circuit Judges Amanda McClendon, Philip Smith, and Thomas Brothers, Special Master Marsh Nichols, Juvenile Court Judge Sheila Calloway, the Davidson County Clerk & Master’s Office, the Executive Office for Immigration Review, and the CLE Commission.
Second Circuit Court of Davidson County | Judge McClendon
Judge McClendon has shared the following updated notice regarding matters pending in her Court:
Second Circuit shall be conducting remote dockets daily, Monday through Friday, from 9:00am until 12:00pm.
• Bridge conference calls shall occur every Monday, Tuesday, Wednesday, Thursday, and Friday effective Monday, March 16 until Saturday, March 21. It is anticipated that this procedure shall be continued per the Supreme Court Order for another week thereafter.
• The docket call shall commence at 9:00am and last 3 hours and you may join the call up to 5 minutes before scheduled start time.

Hearings set on the regular civil motion docket on March 20 will be continued to another hearing date as agreed to by the parties or heard on the 20 remotely through a telephone bridge by the attorneys calling as stated above. This procedure shall continue thereafter for the period specified by the Tennessee Supreme Court.
Impaired driver criminal dockets have been rolled forward and split due to the volume pending. The first date shall be April 8, 2020. Emergency matters such as bond reductions can be heard remotely during a remote bridge docket. These Motions must be filled in advance, the Defense attorney must contact assigned ADA and both attorneys must agree on a time and day to call into the bridge, Monday through Thursday. It is preferred that criminal matters can be heard at 11:00am. Mr. Britt must receive an emailed copy of the motion and responses by 3:30pm the business day preceding the hearing date.
Hearings on Petitions for Emergency Conservatorships and Emergency Limited Healthcare Fiduciaries (and related matters) shall be heard at 9:00am Monday through Thursday. The meetings shall occur at 9:00am telephonically by following the bridge procedure described above.
For settlements occurring during the week starting March 23, the petition(s), exhibits, affidavits and proposed Orders must be emailed to wbritt@jis.nashville.org no later than 3:30pm the business day preceding the settlement date. Participation shall be remotely utilizing the procedure for calling in telephonically.
Fourth Circuit Court of Davidson County | Judge Philip Smith
Judge Smith has provided the following guidance:
Beginning Monday, March 16, Judge Robinson and Judge Smith will assist Special Master Ballinger with the Order of Protection docket so that there will not be too many people crowded in one courtroom. Additionally, only litigants, their attorneys, and witnesses will be allowed in the courtrooms. This is to allow sufficient room in each courtroom to allow everyone to practice social distancing. This will also allow the Order of Protection dockets to be completed in a timely manner which will allow everyone involved to leave the courthouse quicker.
Fourth Circuit will be conducting a modified uncontested docket on Tuesdays and Wednesdays. All default hearings will be continued to a date beyond March 31. The Court will conduct hearings on the irreconcilable differences matters by telephone conference with the lawyers and litigants or, in the case of pro se’s, with the litigants themselves. Lawyers will need to have their clients at their office to conduct the hearing. Of course, the case can be continued at the request of either or both parties. Contrary to the usual practice in Fourth Circuit, while in person hearings are prohibited, all Final Decrees will need to be e-filed. The docket may take longer to complete than usual so please be patient.
All Temporary Restraining Orders or Injunctions that have been issued by the Court will remain in effect until further hearing pursuant to Rule 65.07 of the Tenn. R. Civ. Pro. and by Order of the TSC.
If there is a TRO request that you need to file on behalf of your client please e-file the request and Judge Smith will address it.
All Judicial Settlement Conferences will be continued.
All cases set on the contested docket will be continued.
All cases set on the show cause docket will be continued.
The motion docket will be heard by conference call on all motions that are determined to be a priority. Motions that are not determined to be a priority will be continued to a motion docket after April 6. Motions to withdraw will be continued to a motion docket after April 6. Fourth Circuit will not add any additional future cases to the trial calendar this upcoming week. Any exhibits that will be introduced at the motion hearing should be e-Filed in advance of the hearing.
Sixth Circuit Court of Davidson County | Judge Brothers
Effective immediately, and pending further orders of this Court, there shall be no court appearances or oral arguments concerning any motion docket in the Sixth Circuit Court. All motions shall be decided on written briefs. Any motion to which there is no timely written response shall be treated as unopposed in accord with Local Rule 26.04(g) and counsel are directed to prepare an order granting the relief requested.
Special Master | Marsh Nichols
All case management conferences will be held strictly by phone with no appearances. Lawyers may dial in to 615-880-2548. Special Master Nichols prefers to be called at her office number; however, she may also be reached on her cell phone at 615-260-8121.
Davidson County Juvenile Court | Judge Sheila Calloway
Effective at the close of business on Friday, March 13, the following will occur (subject to further changes as contingencies arise):
- The court will continue to operate detention and preliminary hearing dockets. The preliminary hearing docket will occur each Monday through Friday at 9:00am. The detention docket will occur each Monday through Friday at 1:00pm. All emergency matters shall be consolidated onto those dockets.
- The child support contempt dockets in which a respondent is incarcerated shall continue to occur each Tuesday at 8:30am. In addition, any motions for release filed by incarcerated respondents relating to child support shall be consolidated onto those Tuesday dockets.
- Any delinquency case that involves a juvenile currently in detention remains on as presently scheduled. Trials for those juveniles in detention will occur as scheduled. Any youths currently in detention and on for settlement will be handled by their counsel and the assistant DA in conjunction with the individual magistrate assigned to the case.
- The clerk’s office will remain open for the filing of petitions. They will work with the court to determine when to schedule non-emergency petitions.
All other trials, appearances, settlement conferences and reviews will be continued. The court will notify counsel as to when those case will be reset for status. Please call off any witnesses for those cases. In addition, if an interpreter was requested, please notify administration.
Davidson County Chancery Court | Clerk & Master’s Office
The Clerk and Master’s Office is open, but in-person service is being limited. Please call the office or use the “contact us” function on the website. E-filing is strongly encouraged. Facsimile filing is also available as applicable.
Executive Office for Immigration Review
Effective March 16 through April 10, all non-detained master calendar hearings are postponed. As a result of EOIR’s ongoing evaluation of the information available regarding the spread of coronavirus across the Nation, all other hearings will proceed as scheduled. Those whose hearings are postponed can expect a new hearing notice by mail at least 10 days before their new hearing day. Filings will occur under typical process, except in Seattle. Tennessee Commission on Continuing Legal Education

Below is the latest news from the Metropolitan General Sessions Court, the Davidson County Circuit and Chancery Courts, the Davidson County Circuit Court Clerk, and the Tennessee Court of Workers’ Compensation Claims.
Metropolitan General Sessions Court
Pursuant to the Tennessee Supreme Court Order issued today, the Metropolitan General Sessions Court Judges have approved an abbreviated docket schedule. The details from the press release are:
Pursuant to the … State Supreme Court Order issued today, the Metropolitan General Sessions Court Judges have approved an abbreviated docket schedule in the interest of public safety. This schedule will operate from Monday, March 16-Thursday, April 9 with Friday, April 10 being a holiday.
The only dockets open will be the following:
- Felony & Misdemeanor Jail Dockets
- Domestic Violence Jail Dockets
- Orders of Protection
- Emergency Psychiatric Committal Docket
A determination will be made before April 9th whether to continue this abbreviated schedule.
Davidson County Circuit & Chancery Courts
It is our understanding that the judges of the Circuit and Chancery Courts will be communicating directly with attorneys who have matters pending in their courtrooms about how they will be handling court appearances affected by the Tennessee Supreme Court Order issued earlier today. LETTER FROM THE PRESIDENT: THE LATEST ON DISASTER LEGAL RESPONSE UPDATE
Dear NBA Members,
The NBA and the other groups coordinating the legal response to the recent tornado disaster met by conference call yesterday to discuss the progress made in the week since we first met at the NBA offices. The Legal Aid Society reported that the Gallatin Free Legal Clinic held on March 10 was well-staffed by Nashville lawyers, and that the clinic had a significant increase in people seeking help. Thank you to our members who responded to this need in our community!
FEMA has three Disaster Recovery Centers in Nashville where survivors can go for information and to register for services. FEMA will also be opening DRCs in Wilson County and Putnam County. As of last night, FEMA reported that 2,500 tornado survivors have registered for disaster assistance. More registrations are expected in the days and weeks to come.
The NBA is teaming up with Legal Aid, Napier-Looby, and the TBA to host the North Nashville Legal Clinic on Thursday, March 19, from 4:00 to 6:00pm at the Matthew Walker Comprehensive Health Center. To volunteer for this clinic, please email Andrae Crismon.
If you have not already, please sign up to attend the FREE training session on Tuesday, March 17 at the NBA. As you know, the chances of conducting in-person events is getting slimmer by the day. If this training session is able to be held live, it has been approved for 2 hours of general credit CLE. Due to concerns about the spread of COVID-19, the NBA will be filming the training and providing the video to our members to view remotely following the in-person seminar. However, due to the rules of the CLE Commission, we are unable to provide CLE credit for those who choose to view the video remotely.
The Legal Aid Society recently launched Pro Bono Matters, a new catalog on its website which allows attorneys to review case descriptions and volunteer to handle cases. This roll out could not have come at a better time when the need for pro bono legal assistance in Middle Tennessee is expected to drastically rise in response to the tornadoes.
Thank you for your continued efforts to provide valuable legal services to our most vulnerable citizens. In times like these, we truly can see how the NBA unites our members and strengthens our connection to the greater Nashville community.

LETTER FROM THE PRESIDENT: BREAKING COURTHOUSE NEWS
Dear NBA Members,
The Supreme Court of Tennessee has put down an Order Suspending In-Person Court Proceedings. This Order is in response to the COVID-19 pandemic, and it suspends all in-person proceedings in all state and local courts in Tennessee, with several notable exceptions for certain criminal, domestic violence, child custody, and other emergency proceedings. Please take care to review the order in detail for these exceptions.
The Order includes an extension of certain deadlines, statutes of limitations, and statutes of repose, stating:
Deadlines set forth in court rules, statutes, ordinances, administrative rules, or otherwise that are set to expire between March 13 and March 31, 2020 are hereby extended through April 6, 2020. Statutes of limitations and statutes of repose that would otherwise expire during the period between March 13 and April 6, 2020 are hereby extended throug April 6, 2020. See Tenn. Code Ann. § 28-1-116 (2017). Deadlines, statutes of limitations, and statutes of repose that are not set to expire between March 13 and April 6, 2020 are not extended or tolled by this order.
Court Clerks are charged with ensuring that court functions continue. It does not prohibit court proceedings by telephone, video, teleconferencing, email, or other means that do not involve in-person contact.
The Order also extends Orders of Protection and Temporary Injunctions set to expire between March 13 and March 31, until April 6, 2020.
Under the Order, the courts of Tennessee remain open.We will continue to share information as we receive it.

LETTER FROM THE PRESIDENT: BREAKING COURTHOUSE NEWS
Dear NBA Members,
This afternoon the US District Court for the Middle District of Tennessee announced several courthouse restrictions for the Estes Kefauver Federal Building and US Courthouse in response to the COVID-19 virus outbreak.
The public notice prohibits people who have traveled to certain countries in the 14 days, or had contact with anyone who has traveled to those countries in the same time period, from entering the courtrooms and court areas. It also prohibits entry to anyone who has been asked to self-quarantine by medical providers or health agencies, anyone who has been diagnosed with COVID-19 or had contact with anyone who has been diagnosed, and anyone with fever, cough, or shortness of breath.
The Court provides instructions on who to contact if you are unable to appear because of the stated restrictions. The restrictions will continue until the Court determines it is safe to remove them.
The Tennessee Supreme Court is expected to issue an order addressing COVID-19 concerns for our state courts by tomorrow. The Tennessee Administrative Office of the Courts has current coronavirus information here.

LETTER FROM THE PRESIDENT: URGENT NEED FOR GALLATIN LEGAL CLINIC VOLUNTEERS
Dear NBA Members,
We are happy to report that the Tennessee Alliance for Legal Services (TALS) has the helpline for tornado disaster victims up and running. The number is 1-844-Help4TN. TALS will triage calls with the goal of providing immediate answers if possible, setting appointments with volunteer attorneys for additional assistance, and directing callers to the many clinics already scheduled by the Legal Aid Society.
NBA Board Member and Legal Aid Society Executive Director, DarKenya Waller, has notified the NBA of an urgent need for volunteers for a legal clinic on March 10, in Gallatin. The NBA is answering the call by partnering with the Legal Aid Society to staff the Gallatin Free Legal Clinic. The clinic runs from 4:30-6:30pm and will be held at 210 Albert Gallatin Ave, Gallatin, TN 37066. If you are available to volunteer, please email Zachary Oswald.

LETTER FROM THE PRESIDENT: DISASTER LEGAL RESPONSE UPDATE
Dear NBA Members,
The Nashville Bar Association hosted a meeting this morning in our offices to coordinate the legal response to the recent tornado disaster. Leaders of the NBA, Tennessee Bar Association, American Bar Association, Napier-Looby Bar Association, Legal Aid Society of Middle Tennessee and the Cumberlands, Tennessee Alliance for Legal Services (TALS), and the Tennessee Fair Housing Council met to coordinate efforts to provide pro bono legal services and public education to victims of the tornado and storm disaster in Nashville and surrounding counties.
Through a memorandum of understanding with Federal Emergency Management Agency (FEMA), the ABA YLD provides Disaster Legal Services in coordination with state and local bar associations and legal aid organizations. The Director of the ABA Disaster Legal Services, Linda Anderson Stanley, reported that Governor Lee has requested an expedited disaster declaration from FEMA.
In anticipation of the FEMA declaration, a central hotline is being set up by TALS to receive calls from the public seeking legal assistance. The hotline number will be provided once it is established.
We will be providing NBA members with information on where to sign up to volunteer for pro bono legal services related to the disaster, along with information on upcoming training sessions.

Our hearts go out to our neighbors across Nashville and Middle Tennessee who have been impacted by last night’s tornado. We are concerned about our staff, members, and volunteers who may have been in the path of destruction. The Nashville Bar Association Board of Directors, in conjunction with other legal organizations like the Tennessee Bar Association, is assessing how we may be of greatest assistance to those in need following the devasting storms. We will provide updates as plans develop.

As a result of the resignation of Davidson County General Sessions Judge Angelita Blackshear Dalton upon her succession to the Davidson County Criminal Court, effective November 30, the Metropolitan Council is required to fill the vacancy until the next general election pursuant to Article 7, § 2 of the Tennessee Constitution. Nominations are now being sought for the Jack Norman, Sr. Award that will be presented during the Nashville Bar Association’s Law Day Luncheon on Friday, May 5. This award is given to criminal law practitioners—including specifically defense attorneys, prosecuting attorneys, and judges of courts with criminal jurisdiction—who practice before or serve as judges of courts exercising criminal jurisdiction located in the Metropolitan Nashville area. The award may be given posthumously and is not necessarily presented every year, but only when a deserving individual is to be recognized.
The Norman Award must be given to an attorney whose primary practice is in or service pertains to criminal law, demonstrates respect for the rights of all individuals in the criminal justice system, exhibits the trial advocacy skills or judicial skills necessary to the pursuit of justice, demonstrates an abiding respect for the law and legal profession, maintains highest standards of professional integrity and ethical conduct, and contributes to the improvement of the legal profession and criminal justice system—including but not limited to the provision of uncompensated or undercompensated representation of the accused.
