Summary
Over the past 10 years it is now unusual for any commercial lawsuit to not be mediated (whether required by a contract, court order or agreement). The issue that lawyers are not taught in law school or in their practice about the best ways to prepare for and be an advocate for their clients in a mediation in order to provide the clients with the best possible settlement outcome. This presentation will focus on the top 10 mistakes that an experienced mediator has seen lawyers make in mediations, with an emphasis on how to not only avoid those mistakes, but also provide valuable practice advice and tips.
