Summary

While putting binding arbitration clauses into construction contracts is normal, over the past 15 years, other industries (real estate, banks, insurance) have been placing such clauses in contracts choosing to submit disputes to binding arbitration vs court. Trying an arbitration is different than court, and since most arbitration awards are non-appealable, knowing how best to advocate for your client is essential. This presentation will focus on the top 10 mistakes that an experienced arbitrator has seen lawyers make in arbitrations, with an emphasis on how to not only avoid those mistakes, but provide valuable practice advice and tips to provide your clients the best possible representation for success.
