Summary

What is the future of Birthright Citizenship in the US? Is the most recent executive order about Birthright Citizenship unconstitutional? This CLE will explore the complex and evolving issue of birthright citizenship in the United States, with a focus on recent developments and ongoing legal challenges. The session will begin with an overview of the historical foundations of birthright citizenship, particularly the 14th Amendment's guarantee of citizenship to those born on U.S. soil. Attention will then turn to the Trump administration's executive order in 2025, which aimed to end birthright citizenship for certain foreign nationals. The discussion will include an examination of the pending litigation surrounding the executive order and the constitutional questions it raises. The presenter will also address the broader political and legal debates surrounding birthright citizenship, including its intersection with immigration reform, administrative law, and constitutional law issues. In addition, attendees will review recent court rulings on birthright citizenship and consider potential future challenges and changes to the law. Participants will leave with a deeper understanding of the ongoing litigation and the potential impact on immigration law and policy moving forward.
